    Austin Marketing + Development Group respects the intellectual property rights of others and expects users of https://austintexascondos.com ("the Site") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement that are reported to our designated Copyright Agent identified below.

    1. Filing a DMCA Notice

    If you believe that material on the Site infringes a copyright you own or control, please send a written notice to our Copyright Agent containing the following:

    • A physical or electronic signature of the copyright owner or authorized agent.
    • Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works).
    • Identification of the material claimed to be infringing, including the URL or specific location on the Site sufficient to permit us to locate it.
    • Your name, mailing address, telephone number, and email address.
    • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
    • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

    3. Counter-Notice

    If you believe material you posted was removed by mistake or misidentification, you may submit a counter-notice containing:

    • Your physical or electronic signature.
    • Identification of the material that was removed and the location at which it previously appeared.
    • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
    • Your name, address, and phone number, and consent to the jurisdiction of the federal court in Travis County, Texas, and acceptance of service of process from the complaining party.

    4. Repeat Infringers

    We will, in appropriate circumstances, terminate the access privileges of users determined to be repeat infringers.

    5. False Claims

    Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.

    6. MLS / IDX Content

    Real estate listing photographs and content displayed via IDX are sourced from Unlock MLS (Austin Board of REALTORS®) under license. Listing brokers retain copyright in their listing photographs. Concerns about specific MLS-sourced content should be directed both to our Copyright Agent and to the listing broker identified on the relevant listing page.
